Legal notice

This internal review reconciles VINCERE's Sep 2026 launch policies with current official Australian guidance. It is not a substitute for formal legal advice.

Australian Consumer Law - Key Outcomes

  • VINCERE may choose not to offer change-of-mind returns. Australian Consumer Law does not generally require a remedy where the customer simply changes their mind.
  • VINCERE cannot use a 7-day, 14-day or other store deadline to remove consumer-guarantee rights for faulty goods.
  • The updated customer policy therefore uses 7 days as a prompt-notification request only, with an explicit Australian Consumer Law carve-out.
  • Faulty, damaged or incorrectly supplied goods may require repair, replacement, refund or another remedy
    depending on the issue.
  • If a confirmed faulty product is returned by post, reasonable return costs may need to be reimbursed.
  • Product descriptions, mockups, samples and express promises must accurately represent what customers receive.

Preorder / Delivery Timing

  • A 4-5 week production estimate is acceptable as an estimate if it is presented truthfu
  • lly and updated when material delays become known.
  • The policy clearly separates factory production from freight to Melbourne, inbound QC and final customer delivery.
  • If VINCERE cannot supply paid goods within a reasonable revised time, a customer solution may be required.

Terms & Unfair Contract Terms

Standard-form terms should be clear and should not create an unnecessary significant imbalance against consumers. The updated Terms avoid absolute disclaimers and preserve non-excludable consumer rights.

Privacy

  • Most Australian small businesses with annual turnover of $3 million or less are not covered by the Privacy Act unless an exception applies.
  • Because VINCERE's exact legal entity, annual turnover and exception status have not been legally verified, the Privacy Policy is drafted to follow transparent APP-style practices without making an unsupported claim about
    mandatory coverage.
  • If VINCERE becomes an APP entity, the policy should remain current and explain collection, use, access/correction, complaints and likely overseas disclosures.

Email / SMS

  • Transactional preorder, payment, production and shipping messages should remain factual.
  • Marketing emails/messages require consent and a functional unsubscribe process.
  • Do not add promotional banners/offers to service emails unless the message also meets Spam Act marketing
    requirements.

Items Still Worth Lawyer Review

  • VINCERE's legal entity name, ABN and exact business address/contact details.
  • Whether the Privacy Act applies to VINCERE based on turnover and activities.
  • Final governing-law/jurisdiction wording.
  • International tax/duties disclosures and any destination-specific obligations.
  • Any influencer/creator, model, photographer, wholesale or licensing terms not covered by these retail policies.
